1. Acceptance
By using https://automizeleads.com or engaging Automize Leads ("we," "us") for lead-generation services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
2. The Service
Automize Leads sources motivated home sellers via SMS and outbound calling against publicly available property data, qualifies each raised hand using AI and human verification, and delivers the qualified lead to the client's designated CRM.
3. Lead Definition and Replacement
A "qualified lead" under our service is defined as a property owner who has been contacted, has affirmatively engaged about selling, has provided motivation (cited reason), and has stated a timeline. If a delivered lead does not meet these criteria, the client may flag it within 7 days of delivery and we will replace it within the same billing cycle. Replacement is the sole remedy for lead-quality disputes.
Replacement excludes circumstances outside our control — including but not limited to client failure to call back within 48 hours of delivery, leads where the client's outreach violates TCPA / DNC, or markets in which the client has concurrently engaged competing services.
4. Exclusivity
County exclusivity is granted in writing for the term of the engagement and applies only to seller leads sourced through our service. Exclusivity does not restrict the client or any third party from independently sourcing leads in the same county through other means.
5. Billing and Cancellation
- Engagements are month-to-month unless a longer term is agreed in writing.
- Invoices are due on receipt; late payment after 10 days may pause delivery and exclusivity.
- Either party may cancel with 30 days' written notice. No refunds for partial months.
- All fees are non-refundable except as specifically provided in this agreement.
6. SMS Program Terms
Use of our SMS demo or seller-qualification system is governed by our SMS / A2P 10DLC Compliance Policy. Texting our demo number opts you in to receive informational SMS for the duration of your demo session. Reply STOP at any time to opt out. Message and data rates may apply.
7. No Income or Performance Claims
Testimonials, case studies, and statistics on our site reflect individual investor experiences and do not constitute a guarantee of results. Real estate investing carries risk; outcomes depend on market conditions, capital, operator skill, and execution.Automize Leads does not promise any specific number of contracts, deals closed, or revenue.
8. Client Responsibilities
- Maintain a working CRM or webhook endpoint for delivery
- Call delivered leads back within 48 hours to preserve quality
- Operate in compliance with TCPA, DNC, state RE licensing, and disclosure laws
- Honor seller opt-outs immediately upon receipt
- Maintain truthful representation in all communications with sellers we deliver
9. Intellectual Property
All site content, designs, software, AI models, training data, and methodologies are the property of Automize Leads or its licensors and are protected by copyright and other IP laws. Clients receive a non-exclusive license to use delivered lead data for their own acquisition activity. Resale or redistribution of leads is prohibited.
10. Limitation of Liability
To the maximum extent permitted by law, Automize Leads shall not be liable for any indirect, incidental, consequential, or punitive damages. Total cumulative liability is capped at the fees paid by the client in the 3 months preceding the claim.
11. Indemnification
Client agrees to indemnify and hold harmless Automize Leads, its officers, employees, and contractors from any third-party claim arising out of client's use of delivered leads, including but not limited to TCPA/DNC violations, RE licensing issues, or misrepresentation in seller communications.
12. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflicts-of-laws principles. Disputes shall be resolved in courts located in Philadelphia County, PA.
13. Changes
We may update these Terms; material changes will be flagged at the top of this page and emailed to active clients. Continued use after updates constitutes acceptance.
